2) Scope
This policy applies to the ph413.pt website and to contacts with us made online (forms, email) and offline. The site is not an e-commerce website. Our audience includes users in Portugal and international users.
3) Services and roles (who processes your data)

Own services: real estate consultancy and construction – PH4:13 CONSULTING, UNIPESSOAL LDA acts as the controller.

Credit intermediation: when you ask us to proceed with a credit request, we collect and forward the strictly necessary documentation for assessment to DS Intermediários de Crédito (Decisões e Soluções – Intermediários de Crédito, Lda.), which acts as an independent controller during the assessment/decision phase and publishes its own Privacy Policy on its official website.

Insurance mediation: when you request insurance, we collect and forward the necessary documentation to DS Seguros and partner insurers, which act as independent controllers during assessment/contracting and publish their own privacy policies.
(“Forward” means we process the minimum necessary to submit your request to the competent entities.)
4) Data we process and purposes (essential version, with legal basis)

Contacts and forms: name, email, phone number and message content — to reply to enquiries and schedule meetings.
Legal basis: pre-contractual steps and/or legitimate interests (GDPR Art. 6(1)(b) and (f)). -
Provision of own services (real estate & construction): identification/contact details and project/site information you provide — for quoting, project management and performance; invoicing and legal/tax compliance.
Legal basis: contract performance and legal obligation (Art. 6(1)(b) and (c)). -
Credit (when requested): identification and supporting documents such as ID/passport, NIF/tax number, proof of address, IBAN, income tax return, payslips, bank statements, and other financial/professional data necessary for assessment.
Purpose: analysis and forwarding to DS Intermediários de Crédito and financial institutions.
Legal basis: pre-contractual steps/contract (Art. 6(1)(b)); legal obligation where applicable (e.g., AML/KYC – Art. 6(1)(c)); consent for specific disclosures where required (Art. 6(1)(a)). -
Insurance (when requested): identification and documents required for risk/contract (for certain lines, health information or relevant history you provide may be necessary).
Purpose: obtaining simulations/quotes and forwarding to DS Seguros and insurers.
Legal basis: pre-contractual steps/contract (Art. 6(1)(b)); explicit consent where processing involves health data or other special categories (GDPR Art. 9(2)(a)); legal obligation where applicable (Art. 6(1)(c)). -
Technical security of the site: minimal technical logs (e.g., truncated/anonymous IP, user-agent, access logs) — for stability and abuse/fraud detection.
Legal basis: legitimate interests (Art. 6(1)(f)).
Special categories (sensitive data): we only process health data or similar where strictly necessary for your request (typically life/health insurance) and with your explicit consent, forwarding it securely to the competent entities. We do not use such data for marketing profiles.
5) Recipients and international transfers

6) Retention periods (data minimisation by design)

Leads/requests without engagement: up to 12 months after last contact.

Clients and contractual documentation: for the duration of the engagement and 10 years (tax/accounting obligations).

Credit/insurance documents received for forwarding: we keep only what is necessary and for the strictly indispensable time to process and evidence the submission; where possible, we do not retain full copies once forwarding is complete.

Technical security logs: up to 12 months.
7) Your rights
You can access, rectify, erase, restrict, object and request data portability.

You also have the right to lodge a complaint with the CNPD — Portuguese Data Protection Authority (www.cnpd.pt).
8) Security
We implement appropriate technical and organisational measures (TLS/HTTPS, access controls, backups and data-minimisation). If a breach with risk to individuals occurs, we will comply with the notification duties under the GDPR and Law 58/2019 (Portugal).
9) Minors
This site is not intended for minors under 18. If we identify data of a minor without a valid basis, we will delete it.
10) Automated decision-making
We do not carry out profiling or automated decisions producing legal or similarly significant effects on users. If partners (financial institutions/insurers) perform scoring or automated assessments, this will be described in their privacy policies.
11) Cookies
11.1 Current status
At present, we do not use non-essential cookies (no analytics or advertising). Only strictly necessary cookies may be used for the website’s basic operation, performance and security.
11.2 How we use cookies

Strictly necessary: enable core functionality (e.g., session management, security and caching) and cannot be disabled by ordinary means without affecting the site’s operation.

Functional (where applicable): remember options such as language. Not used to create user profiles.

For disputes involving insurance mediation, consumers may refer to the sector-specific ADR entity.
For disputes relating to other services (credit intermediation, real estate consultancy and construction), consumers may refer to the territorially competent ADR entity.
